1. Acceptance of Terms
By accessing or using GSMSharing.com ("the Site", "the Service", "we", "us", or "our"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and GSMSharing.
2. Eligibility & Registration
You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms. By creating an account you represent and warrant that all information you provide is accurate and that you have the legal authority to agree to these Terms.
We reserve the right to refuse registration to any individual or entity at our sole discretion.
3. Account Responsibilities
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately at the Contact link below if you suspect any unauthorised use of your account.
You may not transfer or sell your account or any rights associated with it. Each account is for a single individual or entity. Automated account creation ("bots") is strictly prohibited.
4. Acceptable Use
You agree not to use the Service to:
- Post, share, or transmit content that is illegal, defamatory, obscene, discriminatory, or otherwise objectionable.
- Upload or share firmware, software, or files that you do not own or are not legally permitted to distribute.
- Scrape, crawl, or systematically download content in a manner that burdens our infrastructure.
- Introduce malware, viruses, or any code designed to harm the Service or its users.
- Circumvent any access controls, rate limits, or security measures.
- Engage in spam, phishing, or any form of unsolicited commercial communication through the Site.
- Impersonate another person, business, or entity.
- Use the Service for any unlawful purpose, including but not limited to carrier unlocking in jurisdictions where such activity is prohibited.
We reserve the right to investigate and take appropriate legal action, including removal of content and termination of accounts, for violations of this section.
5. User-Generated Content
The Service allows you to post, upload, link, and share content including forum posts, blog comments, repair job listings, file links, images, and other materials ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.
By submitting User Content you grant GSMSharing a worldwide, royalty-free, non-exclusive, transferable licence to use, reproduce, modify, distribute, display, and perform that content solely for the purposes of operating and improving the Service. This licence terminates when you delete the content, except to the extent it has been shared by others or used in derivative works.
You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not endorse any User Content and expressly disclaim all liability arising from it.
6. Intellectual Property
All trademarks, logos, design elements, code, and proprietary content on the Site other than User Content are the intellectual property of GSMSharing or its licensors and are protected by applicable copyright, trademark, and other laws. You may not reproduce, republish, or redistribute them without prior written consent.
Device names, brand names, and firmware identifiers belong to their respective manufacturers and are referenced for informational and repair-compatibility purposes only.
7. Marketplace & Technician Services
GSMSharing provides an online marketplace that connects device repair technicians ("Technicians") with customers ("Clients"). GSMSharing is a platform intermediary only and is not a party to any contract formed between Technicians and Clients.
- Technicians are independent contractors and are solely responsible for the services they describe, quote, and perform.
- Clients are responsible for accurately describing device faults and ensuring devices are shipped safely.
- GSMSharing does not warrant the quality, safety, or legality of services advertised on the platform.
8. Credits & Payments
Certain premium features on GSMSharing require the use of Credits ("Credits"), which are a non-monetary, non-transferable virtual currency. Credits cannot be exchanged for cash or transferred between accounts unless explicitly stated.
Credits may be purchased via the supported payment methods listed on our Payments page. All purchases are final. Refunds are issued only at our sole discretion and only in cases of billing errors or technical faults on our part.
Prices are displayed in US Dollars (USD) unless otherwise stated. We reserve the right to change pricing, Credit bundles, and payment methods at any time with notice to registered users where reasonably practicable.
We use third-party payment processors. By making a purchase you also agree to the terms and privacy policy of the relevant processor. GSMSharing does not store full payment card details.
9. Escrow & Dispute Resolution
Where marketplace transactions use the GSMSharing escrow system, funds are held by GSMSharing until both parties confirm satisfactory completion, or until a dispute is resolved in accordance with our Dispute Resolution Process. If a dispute is raised, both parties agree to:
- Communicate in good faith through the platform's messaging system.
- Provide any requested evidence (photos, messages, invoices) within 72 hours of request.
- Accept GSMSharing's final decision as binding, subject only to applicable consumer protection laws.
GSMSharing charges a platform fee on completed marketplace transactions. The fee schedule is displayed at the time of listing and is subject to change with reasonable notice.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.
11. DMCA & Copyright
GSMSharing respects intellectual property rights and expects users to do the same. If you believe any content on the Site infringes your copyright, please submit a DMCA notice via our Contact form with:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the infringing material and its location on the Site.
- Your contact information (name, address, telephone number, and email).
- A statement of good faith belief that the use is not authorised.
- A statement under penalty of perjury that the information is accurate and you are authorised to act on the copyright owner's behalf.
Upon receipt of a valid notice we will remove or disable access to the allegedly infringing content promptly and notify the user who posted it.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GSMSHARING DISCLAIMS ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. File links and firmware hosted or linked by users are provided without any warranty of fitness, safety, or legality for any specific device or jurisdiction.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GSMSHARING, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM:
- Your access to or use of (or inability to use) the Service.
- Any content obtained through the Service.
- Any transaction between users through the platform.
- Any device damage caused by firmware, software, or instructions shared on the Site.
In no event shall GSMSharing's total liability to you exceed the greater of (a) the amount you paid to GSMSharing in the twelve months preceding the claim, or (b) USD 50.
14. Termination
We may suspend or permanently terminate your access to the Service at any time, with or without notice, for any conduct that we believe violates these Terms, is harmful to other users, to us, or to third parties, or for any other reason at our sole discretion.
Upon termination your right to use the Service will immediately cease. Sections 5, 6, 12, 13, 16, and 17 shall survive termination.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. If a change is material we will endeavour to provide at least 14 days' notice via a site banner or email before the change takes effect. Your continued use of the Service after any change constitutes acceptance of the new Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which GSMSharing operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
